PETALING JAYA – A woman was fined RM100,000 by the Sessions Court here on Tuesday for operating an unregistered private dental clinic six years ago.
Judge Dr. Syahliza Warnoh ruled that the defence representing Nurul Syafiqaa Ali, 27, had failed to raise reasonable doubt at the end of the defence case.
However, the woman, as the defendant, was sent to Kajang Prison to serve a 12-month jail sentence after failing to pay the fine.
According to the amended charge, the woman was accused of providing an unregistered private dental clinic under Section 27 of the Private Healthcare Facilities and Services Act 1998, in Puchong Prima, here at 2.30 pm on April 6, 2021.
She was charged under Section 4(1) of the Private Healthcare Facilities and Services Act 1998 and could be punished under Section 5(1) of the same Act, which carries a fine of not exceeding RM300,000 or imprisonment not exceeding six years or both, if convicted.
Based on the case facts, on April 6, 2021, a team of officers from the Private Medical Practice Control Branch, Selangor State Health Department, raided a premises in Puchong Prima after receiving information about an unregistered private dental clinic operating there.
During the raid, the defendant was providing dental brace installation treatment to a woman.
Checks revealed she failed to produce proof of clinic registration as well as an annual practicing certificate as a registered dental practitioner.
