SHAH ALAM: Beverage company, Bubblebee Sdn Bhd was fined RM17,500 by the magistrate’s court here yesterday after pleading guilty to seven charges, including failing to pay overdue contributions to the Social Security Organisation (Perkeso) last year.
Magistrate Ameera Mastura Khamis made the ruling after the company, represented by its two directors, comedian Shahmira Muhamad, 40, also known as Shuib, and Koh Choon Guan, 33, admitted to all the charges.
The court also ordered a two-month prison sentence if the fine is not paid. However, the company was allowed to settle the overdue Perkeso contributions in six instalments.
The company was charged with three counts of failing to make employer and employee contributions for a 25-year-old male worker from October to December last year, totalling RM97.80.
These contributions were required under Section 6(1) and (8) of the Employees’ Social Security Act 1969 and Regulation 32 of the Employees’ Social Security Regulations 1971.
Additionally, the company faced three charges for failing to pay a total of RM17.40 in contributions for the same worker for the same three months, under Section 18(1) of the Employment Insurance System Act 2017 (Act 800) and Regulation 9(1) of the Employment Insurance System (Registration and Contributions) Regulations 2017.
All offences took place at the company’s premises in Taman Industri Alam Perdana, Taman Putra Perdana, Puchong, at around 8.30am on the 16th of each month from November last year to January this year.
The company, founded by Shuib, was also accused of failing to comply with a summons under Section 110(1) of the Employees’ Social Security Act 1969, leading to further charges under Section 110(2) of the same Act, which occurred at the Selangor Perkeso office at around 11am on Jan 10.
If convicted on each charge, they could face up to two years in prison, a fine not exceeding RM10,000, or both.
The prosecution was handled by Perkeso Selangor prosecuting officer Nurul Atikah Che Sarif, while the company was not represented by a lawyer.
